General Terms and Conditions (GTC)
for the website and SaaS platform of aimance GmbH
1. Scope of Application
These General Terms and Conditions apply to all contracts between
aimance GmbH, Cremon 11, 20457 Hamburg (hereinafter referred to as “Provider”) and its commercial customers (hereinafter referred to as “Customer”) using the cloud-based software solution aimance within the framework of a free or paid usage model.
These GTC apply exclusively to businesses (§14 BGB).
2. Subject of the Agreement
The Provider provides the Customer with a cloud-based analytics platform (SaaS) for evaluating Employer Attractiveness as well as data on recruiting and career pages. The exact functionality is determined by the selected license model.
This constitutes a temporary right of use – the software is not sold.
3. Conclusion of Contract
The contract is concluded through:
Registration on the platform and acceptance of these GTC,
or by signing a written offer (e.g., for agency access).
By entering into the contract, the Customer accepts the validity of these GTC.
4. Rights of Use
The Provider grants the Customer a simple, non-transferable, and non-sublicensable right to use the platform for the duration of the contract according to the agreed scope.
5. Customer Obligations
The Customer agrees to:
Keep login credentials secure,
Not use the platform unlawfully or abusively,
Not infringe on the rights of third parties (e.g., through the upload of prohibited content).
6. Fees and Payment Terms
Pricing is based on theselected model.·
The demo version is free of charge.·
Paid models are billed in advance for the respective term.·
Payment is made by invoice and, in the future, possibly by credit card or SEPA.
All prices are net plus VAT.
7. Availability and Maintenance
The Provider strives for 98% average monthly availability.
Planned maintenance will – if possible – be performed outside peak usage hours.
Technical developments or updates may result in temporary limitations.
8. Liability
The Provider is fully liable for intent and gross negligence.
For slight negligence, liability is limited to typical and foreseeable damages and only for essential contractual obligations (cardinal duties). Liability for indirect damages (e.g., loss of profit) is excluded unless legally mandatory.
9. Data Protection
The Provider processes personal data in accordance with the GDPR.
Cookies and services such as Google Analytics are used for analysis.

10. Term and Termination
Paid licenses have a minimum term of 12 months unless otherwise agreed.
The notice period is three months to the end of the month. If no notice is given, the contract is automatically extended by another year.
The right to extraordinary termination remains unaffected.
11. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Jurisdiction – to the extent legally permissible – is the Provider’s place of business: Hamburg.
Amendments and supplements to these GTC must be made in text form.
